Landlord/tenant disputes often arise over security deposits. In Massachusetts, most landlords require payment of the first and last months of rent, as well as a security deposit before a tenant is allowed to occupy the property.
The law holds landlords to some specific requirements, including the following:
- The renter’s security deposit must be put in escrow
- If the landlord fails to put the security deposit in escrow, the landlord can, in some circumstances, owe the renter triple the amount of the security deposit, as well as interest and attorney fees
- The security deposit must be deposited in a Massachusetts-based bank
- The landlord must return the security deposit, less any fees for damages, within 30 days of tenant vacating the property. Failure may result in owing the tenant triple the amount of the security deposit.
